AbstractThis paper explores institutional conflicts of interest ("ICOIs") in the academic medical centers, and finds that there is a clear absence of substantive efforts to confront these conflicts of interest by academic centers themselves. The authors also assess the Jesse Gelsinger case, which resulted in the death of an innocent study participant, and uses this case to discuss both how these conflicts arise, the ineffectiveness of current legislation to address these issues, and finally discuss possible solutions to these issues. The aughts discuss a "Centralized System" model that is free from industry influence and supported by audits performed by federal authorities to ensure compliance. The Centralized System would serve to proactively review, manage, approve, and conduct assessments of potential conflicts, and would have independent power to evaluate and enforce, with sanctions, any violations.
