Abstract

This article analyzes the role of Institutional Review Boards in mandating the use of Certificates of Confidentiality as one such additional safeguard to protect subject privacy. Certificates of Confidentiality are designed to prevent consequential harms associated with compulsory legal disclosure of identifiable research data. However, the scope of the coverage has evolved significantly over time. First established under the Comprehensive Drug Abuse Prevention and Control Act in 1970, the initial protection was limited to identifiable research data on the use and effects of illegal drugs.
