Lund of Boulder Colorado is the owner of Paladin Press, which over the past twenty five years has published six hundred titles in its &quot;action library,&quot; largely marketed on the backs of comic books and match covers. Titles in the library include Breath of the Dragon: Homemade Flamethrowers, Counterfeit Money Made Easy, a &quot;self defense&quot; manual entitled Pool Cues, Beer Bottles, and Baseball Bats, and Be Your Own Undertaker: How to Dispose of a Dead Body. Recently Mr. Lund has been named as the defendant in a lawsuit brought by the surviving 10 year old daughter of a woman who was one of three people killed in a triple slaying. The murderer in this case, who was hired by the slain woman's husband, was recently convicted and sentenced to death. Evidence at the murder trial indicated that the murderer had bought a book from Paladin Press entitled Hit Man: A Technical Manual for Contractors, and followed twenty seven specific instructions in the book, such as using a particular kind of rifle, drilling out the serial numbers, using a silencer, and so forth. Should Mr. Lund be held liable for damages to the 10 year old girl arising out of the murder of her mother? If so, why?
