The American Occupational Therapy Association, Inc.
Article XIV
ETHICS
Section 1. Registered members may accept referrals from qualified physicians
and from others seeking occupational therapy Services. They shall collaborate
with qualified professionals in those instances where collaboration is
indicated.
Section 2. Advertising by registered members under their
professional title shall be in accordance with propriety
and precedent in health professions.
Section 3. Members shall maintain competency in occupational
therapy practice through standards established by the Delegate
Assembly.
Section 4. Members shall provide only those services for
which they are properly qualified by registration or certification.
Section 5. The registered member shall assume responsibility
for services provided to clients and is obligated to provide
continuing supervision
when any portion of the service is delegated to supportive personnel.
He shall not delegate to an unqualified person any services which require
professional skill and judgment.
Section 6. Members shall respect the confidentiality of
all privileged information.
Section 7. Registered members shall charge only for services
actually rendered by them or under their supervision.
Section 8. Members shall be responsible for clearly delineated
documentation of all professional services provided.
Article XV
DISCIPLINARY ACTION
Section 1. Members of the Association may be censured. reprimanded,
suspended or expelled for violation of Association ethics or malpractice.
Section 2. Charges against a member shall be referred in
writing to the Executive Board. The board shall activate
a disciplinary panel to
be chaired by the vicepresident of the Association. Panel members shall
include the AOTA Council on Practice chairman. the president, delegate
and practice committee chairman or in the absence of such a committee,
the ditly elected representative to the Council on Practice. of the affiliate
association in or near the geographical area of his i,esidence. The disciplinary
panel shall investigate the charges and notify the member of such charges
and a date set for his hearing. The date shall not be less than 30 days
following such notice.
Section 3. The nature of the violation and the numbcr of
offenses shall guide the disciplinary panel in determining
any action warranted.
Section 4. A unanimous vote of the disciplinary panel shall
be required for suspension or expulsion.
Section 5. The member involved shall be notified of the
panel's action.
Section 6. The member may. within thirty days after notification
of action by the disciplinary panel request the Executive
Board to consider
any question of law, ethics or procedure therein.
Section 7. Members suspended or expelled under the provisions
of this article shall be eligible for reinstatement upon
application approved
by two-thirds vote of the Delegate Assembly.
*Effective 11/11/76, these articles do not appear in the
AOTA bylaws, as the Association is currently revising its statement of
standards and ethics.
